1. Acceptance of Terms

By accessing or using LaunchKit AI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

LaunchKit AI is an AI-powered platform that generates app store publishing assets including store listings, keywords, release notes, screenshot captions, marketing copy, promotional mockups, and logos for mobile applications.

The Service uses third-party AI providers (including OpenAI) to generate content. Generated content is AI-assisted and should be reviewed before publication.

3. Account Registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration.
• One person or legal entity may not maintain more than one free account.

4. Credits and Payments

4.1 Credit System

The Service operates on a credit-based system. Each AI operation consumes a set number of credits as specified on the Pricing page. Credits are non-refundable once consumed.

4.2 Credit Packs

Credit packs are one-time purchases processed via Stripe — there is no recurring billing and nothing to cancel. Purchased credits are added to your account immediately and do not expire or reset.

4.3 Refunds

Credit pack purchases are non-refundable except where required by law.

4.4 Price Changes

We may change our pricing at any time. Price changes only affect future purchases — credits you've already bought keep their value and are never affected.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe the intellectual property rights of others
• Generate content that violates OpenAI's usage policies
• Attempt to circumvent the credit system or otherwise abuse the Service
• Use automated tools to make excessive API calls that degrade service performance
• Resell or redistribute the Service without prior written consent
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any unlawful purpose

6. Content Ownership and Licencing

6.1 Your content

You retain ownership of all app data and project information you provide to the Service. By submitting content, you grant us a limited licence to process it solely to provide the Service.

6.2 Generated content

Subject to your compliance with these Terms and payment of applicable fees, you own the output generated by the Service using your project data. You are responsible for ensuring generated content complies with app store policies and applicable laws before use.

6.3 No guarantee of uniqueness

Due to the nature of AI generation, similar outputs may be generated for different users. We do not guarantee that generated content will be unique or will not infringe third-party rights.

7. AI-Generated Content Disclaimer

AI-generated content may contain inaccuracies, errors, or content unsuitable for certain audiences. You are solely responsible for reviewing, editing, and verifying all generated content before publishing it to any app store or platform.

We do not guarantee that AI-generated content will meet app store submission requirements or result in approval. App store guidelines change frequently and are the responsibility of the developer.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or terminate the Service for maintenance, security, or operational reasons with reasonable notice where possible.

AI generation times may vary depending on model availability and request volume. Credits are not deducted for failed generations; they are automatically refunded if an error occurs.

9. Termination

You may cancel your account at any time via the dashboard settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

Upon termination, your access to the Service ceases and unused credits are forfeited. We may retain data as required by law or our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, LaunchKit AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or app store rejections.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that generated content will be accurate, complete, or fit for a particular purpose.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
